Subway Sued Over Skimpy Sandwiches Advertised as Humongous

Longtime Mouse Print* readers will remember we wrote probably half a dozen articles about Subway being sued for allegedly not putting any tuna in their tuna sandwiches. We always thought that case was kind of flaky, and it was.

Now, however, a New York consumer and her clever lawyers are more rightfully going after Subway for serving skimpy sandwiches that look nothing like the ones they depict in advertising. In the app, for example, this steak and cheese sub is so overflowing with meat it looks like you could get a hernia trying to lift it.

In the lawsuit, the lawyers allege the sandwich depicted in their advertisement contains more than triple the amount of meat as she was actually served. Had she known that in advance, she would not have made the purchase or would have wanted to pay less.

So the chain is being sued for misrepresentation, as well as misleading and deceptive business practices.

Back in the summer of 2023, we wrote about misleading fast food portion sizes, including showing an advertisement depicting a very fat Subway roast beef sub which really only had 2.5 ounces of meat in it. [See story.]

So this time around, we say to the class action lawyers, go get ’em.

  1. Finally? There’s been a number of such similar suits over the years, several even from this same law firm. They’ve all been dismissed as will probably this one. While I agree with the argument, I don’t think this has a prayer

  2. John Oliver had a very depressing story about Subway awhile back, and made it sound like owning a franchise was a living nightmare.

    My guess is that Subway will just shift the blame to the poor franchisees.

    • This is my assumption more than anything. Subway is going to, maybe rightfully, claim that “X amount of meat is called for on the sub according to our recipes”, and then say it is the fault of the employee or franchisee for not creating this sandwich to specifications.

      This is a cross all franchisees must bear and is one of the risks of franchising.

  3. The local Subway inside Walmart conveniently uses the new fresh covers to hide what is going on during the sandwich making process. When I saw that they used one level scoop of tuna for a six inch sub, I said no thank you and walked away.

    • You are absolutely right. I too noticed the new none see through display windows when my last BMT sandwich was being made. You cannot see how much meat is actually being put in your sub anymore. When I got home, I then noticed that there was very little meat inside the sub. Never again am I going back . . .

  4. At the two locations near me, they are definitely on board with shrinkflation. I used to get a footlong for about $7, which was two meals. Now it’s about $11!! They used to make them so they were full, never like the pictures, but still pretty full. Tried both locations recently, and now they are so skimpy, almost flat, and nowhere near as filling as they used to be. Even when I said something about it, and asked them to put the usual amount, they mumbled something about the recipe and got defensive. I have no plans to go back. Corporate greed is everywhere. Rich executives get richer and richer. And we’re the ones paying the price.

  5. I ate at Subway a couple of nights ago. I always get the BMT. My favorite since day one. It has been a while since I ate there. The meat portion was noticeably smaller than in the past. In fact, the meat was all on one side of the bun instead of being distributed. Another thing they added is a metal guard over the meat/cheese bins. So tall that you can no longer see the sandwich being made. I asked why they added the guard…was told it was to better control the temperature of the product. Seems like a transparent cover would have worked just as well and would have been cheaper to install. Definitely a ploy to hide their doings.

  6. I stopped going to Subway years ago. I only wanted two toppings but would they give me a little more because of it? Not on your life, they acted nasty about it! And then I got a skimpy portion on top of that. And the amount of meat you get is so small now, forget it. I go to the supermarket now for my sandwiches. Big Y here in New England makes great sandwiches at yesterday’s prices. They use good meat from the deli counter and their bread is MUCH better. There is absolutely no reason for me to go to Subway anymore. I don’t know how they stay in business.

  7. For decades now, I proceed under the assumption that everything a corporation says (or shows, or whatever,) is a lie. It has served me very well, being the truth and all…
